In consideration of the mutual promises contained herein and other good and valuable consideration including, without limitation, Straightright LLC’s (referred to as “Straightright” hereafter) agreement to train me and permit my participation in various physical fitness exercises and sporting activities, which may include, without limitation, full contact boxing and martial arts training, (“Physical Activities”) I, the undersigned, hereby, for myself and for my estate, heirs, executors, administrators and assigns forever acquit, discharge, and release Straightright and its agents, employees, shareholders, directors, members, contractors, volunteers, and sponsor(s) (“Released Parties”) from any and all liability for and forever waive any and all right(s) to and agree not to pursue any claim, lawsuit, or other legal action, whether now existing or arising in the future, against the Released Parties for any damages and/or injuries suffered by me during or resulting from my participation in and/or traveling to or from the Physical Activities. I agree to indemnify the Released Parties for any and all legal fees and associated costs resulting, directly or indirectly, from all legal actions and threatened legal actions brought or threatened by myself against the Released Parties.
Although precautions will be taken to ensure my safety, I fully understand and appreciate the Physical Activities will expose me to a substantial risk of incurring serious personal injury including, without limitation, bruising, broken bones, permanent paralysis, brain damage, and death (“Personal Injury”). I voluntarily and knowingly recognize, accept, and assume the risk of and responsibility for Personal Injury to myself resulting from my participation in the Physical Activities. For my safety and the safety of others, I agree to abide by all rules and instructions of Straightright’s instructors and the facilities in which I participate in the Physical Activities. I understand and agree that medical or other services rendered to me by or at the request of any of the Released Parties is not an admission of liability nor does it obligate the Released Parties to provide or continue to provide any such services and shall not act as or be construed as a waiver or renunciation by any Released Party of any right, waiver or release obtained hereunder.
I certify and affirm I have no injuries or health conditions, nor have I had such within the twelve (12) months preceding the date of this Release, including, without limitation, broken bones, hypertension, asthma, irregular heartbeat, brain injury or concussion, excepting those injuries or health conditions I have listed below. I further agree that should I incur or develop any injury or health condition, whether or not specifically mentioned above, I will immediately notify Straightright and will not participate in any Physical Activities until I have received written approval from a licensed health care provider after a physical examination. I certify I have consulted with and received medical clearance from a licensed health care provider prior to beginning any participation in the Physical Activities.
Specifically, participant agrees to hold harmless Straightright and all other individuals, organizations, sponsors, promoters, operators, hosts, instructors, associations, schools, owners, officials, directors, employees and other participants connected with the event from all losses, damages, injuries, causes of actions, claims, or complaints in the event that the participant is damaged or injured in any way during the participation, instruction and/or performance of any exercise or during any activity associated with the event location or during transit to or from the event.
Participant further agrees to strictly obey instructors and observe safety rules.
Because of the physical demands of martial arts and/or personal defense instruction, the participant understands that he/she must be in good physical condition to participate in the event. Participant understands that in case of injury, the only medical treatment {SchoolName} will provide is first aid.
Participant agrees that any pictures, audio, or visual recordings taken of him/her in connection with the seminar can be used for publication, promotion, articles, shows and advertisement without additional consent and without compensation at this time or any other time.
I have read and understand this release and agreement and agree to its provisions. I am not under their influence of any drugs, alcohol, or other intoxicants. I am not suffering from any illness or incapacity. I am over 18 years of age. (If not over 18 years of age, parent or guardian must sign.)
